  1. Like the falls themselves the Canadian-side view of the fireworks is much more spectacular than the American view. The fireworks have furthermore been engineered to linger longer on the Canadian side to the Canadian situated viewer. When you are next in the area cross-on-over, it will cost somewhere between a Lonnie and a Toonie - best time to come is during our winter (August to July) especially on Beaver day. Mush....mush.....

  3. Occasionally I read in logs of people who accuse, or are accused, of trespassing. Sometimes the circumstances do not really imply trespassing has occurred. We just tend to throw this word around thinking that it supports an opinion. Decided to do a little research to get some facts here in Ontario. http://answers.google.com/answers/threadview/id/418240.html Ontario Trespass to Property Act - R.S.O. 1990, Chapter T.21 http://www.canlii.org/on/laws/sta/t-21/20040901/whole.html Under this provincial law, trespassing occurs when someone remains on private property after they have been instructed by the occupant of that property to leave the property. This instruction can be in written form (such as a 'No Trespassing' sign), or verbal (as in 'Get the ***** off my property!'). Ontario's law has the highest maximum fine in Canada, at up to $2000 per offense. The above is basically what I recall from some law course taken a (long) while back. So can a person can wander anywhere they please as long as they have not been warned to stay out nor are they infringing on someone’s livelihood? (i.e. farm). The warning can be of many forms. Signs, fences, and verbal being the most common. Do believe that we always should have respect for other persons and their property and endorse the guideline of having permission to place a cache on private land. But. If permission has not been asked for and no warnings evident is it really trespassing to place a cache on private land. Interested in hearing opinions, especially of those who have experience with the law in this regards

  5. I have picked up an EU coin (embossed Europe on one side) that for whatever reason the tracking number is not recognized by the tracking web site. Format of the tracking number is unusual (EUP#D#-####) and if include the dash the “trackable items” input box will not accept this many characters. Coin looks legitimate. Has the GC logo on it and states that it is trackable Any idea as to what is wrong here?
  6. Seems that a properly trained police/bomb dog is much better at this, and less expendable, than your well experienced geocacher. I hope the police officer thanked you for going in first! I'm not explaining myself on this subject anymore in these forums. I don't claim to know how to program computers and I'm not an accountant, I don't pretend to know what I'm talking about on any of these matters. What I do know is military ammunition and explosives. I have dealt with the public service on many matters like this and I DO KNOW what I'm talking about. If you need me to explain myself do so in person. Woooaaaa.... Take a valium and relax! Wasn't being critical of you in any manner - Was just having some fun with the subject here. Do respect your role and your expertise.

Let me see if I got this correct 1) You found hand grenade 2) You thought it was real enough to call in police and bomb squad, then 3) You took pics after calling bomb squad but before they arrived, or 4) You took pics of grenade before calling bomb squad, or 5) Bomb squad arrives and waits for you to finish taken your memento pics, or 6) Bomb squad arrives and then leaves grenade with you and you take pics of grenada Where is the step where you and the lady get the heck out of there? BTW this could have been a real cool 5.5 terrain rating for the THE 82 cache PS glad no one was hurt
  9. That doesn't explain why the over 90 other caches that have the name Walmart in them have not been touched. Maybe they just have not got to them yet. If they are still there after a period of time then maybe there has been some other driver behind these actions. That reason I will be interested in as I had changed one of my listings to comply
  10. Good point! Suspect the difference might be the fact that Waymarking really just documents "public" information. Be it by coordinates/locations or photographs. Since this is in the public domain it is owned by all. Much like you cannot be sued for speaking the word "wal-mart". Placing your own opinion in the waymark does not infringe on property rights. Now if you enticed people to visit the waymark by use of someone else’s property then an issue may arise. Suspect that may be the issue behind some of the geocache listings.
  11. I just skimmed through this topic so have probably missed many a fine point. Just to add my 2 cents Has anyone considered that Groundspeak may be taking this action to avoid litigation from other companies against them, and not just the lost revenues from advertising? When another company’s name, trademark or other intellectual property is used in a cache listing, AND, Groundspeak endorses the use of that property by publishing the listing they may become liable for damages to the property owner. The use of the trademark “WAL-MART” in a cache listing to “attract” finders and encourage the geocaching activity so that Groundspeak makes more money from premium memberships is simple and a logical conclusion that some lawyers will come too. Sounds ridiculous huh. - Its not. If I owned a Company and saw the unauthorized use of my property so that Groundspeak could make money, or, some not for profit Geocaching club could fund raise, I may consider my options for litigation and getting some damages back. Of course I can’t sue all those premium paid geocachers but I sure can find and sue Groundspeak. I am not an expert in this but I do have experience in these matters through my place of business. BTW when cachedrone asked me to modify a cache listing I had with the word Walmart in it I modified it. It is still listed. Don’t feel any worse over it as I believe I understand what is going on.
