Cache Owner/finder/site Bill Of Rights

Cache Owner Bill of Rights:

 

1. You have the right to place a cache anywhere you choose.

2. You have the right to place any kind of cache you choose, including all variations of existing types or new types that you have invented.

3. You have the right to be creative in developing your cache.

4. You can use any container or none for your cache.

5. You can use any means of verification you choose, including none.

6. You can list the cache by any method at your direct disposal. You can request it be listed on one or more listing sites. You can choose to not list it at all.

7. You can request that the rules of a listing site be changed to accommodate your cache.

8. You can specify who, what, when, and how your cache should be found.

9. You can describe your cache in any way you wish.

10. You have the right to delete, destroy, or disallow any log in any format under your control with or without cause.

11. You have the right to track finders by any means you have the ability to implement.

12. You have the right to set the terms for your cache to be listed on any listing service.

13. You have the right to maintain your cache at any interval you wish, or not maintain it at all.

14. You have the right to make the cache available for finding for any length of time, or to remove it at any time.

 

Cache Finder Bill of Rights.

 

1. You have the right to log or not log the cache by any means available to you.

2. You have the right to say anything at all in your log in any language, using any language, or not using language at all.

3. You have the right to seek or not seek any given cache.

4. You have the right to request that only certain caches be placed or that certain caches get placed in any media you have access too.

5. You have the right to request that your log be allowed as a find.

6. You have the right to quit looking for a cache.

7. You have the right to have fun or not as you see fit.

8. You have the right to hold any expectations you choose on any aspect of a cache hunt.

9. You have the right to trade, up, down, or not at all as you see fit.

10. You have the right to track your finds by any means you have the ability to implement.

11. You have the right to find the cache by any method you choose using any means at your disposal.

 

Listing sites bill of rights.

 

1. You have the right to list any submitted cache of any type for any reason at any time for as long as you choose.

2. You have the right to set a uniform standard for which caches that you will list must meet.

3. You have the right to reject caches submitted for listing for any reason or none.

4. You have the right to list caches in any format in any medium at your disposal.

5. You have the right to set the legal terms of listing and/or logging to be uniform for all cache owners/cache finders who list on your site.

6. You have the right to use the cache data to produce derivative works.

7. You have the right to allow cache finders to log caches on your site.

8. You have the right to set a standard for the content of cache descriptions and logs to be displayed on your site.

9. You have the right to control the content of your site in any way you choose.

10. You have the right to remove a cache from being listed at any time for any reason.

11. You have the right to ban the account of any finder or owner with or without cause.

I probably missed a few, but the idea is these rights are all absolute. They can not be taken away, they can only be surrendered. Even though they are absolute they are tempered in the real world by the rights of others relative to the goals you want to achieve, and the prevailing laws of the land.

 

All these rights conflict, it’s tempering these rights with reality that allows us to play this game. While a cache owner has the right to make a cache so inane that nobody will find it, if they actually want it found they will make their cache fit the more mainstream view. If all finders started only logging in a personal notebook soon cache owners would lose interest in placing caches and they would have nothing more to find and so on. If a listing site only listed gold star caches they would soon find they have no listings and even the gold star caches would be listed elsewhere. Most of the forum wars are from this blending of conflicting rights with reality.

 

Power aggregates to the one with the most control. Thus if a cache owner or owners have 90% of the hides in an area they can set which geocaching site will dominate the area. Alternately if the local finders all decide that they will only post logs on NewCacheListing.com the disorganized owners will soon learn that to get logs they have to list there. For the most part the place where all our listings and logs are aggregated has assumed the power. It’s the nature of the beast. Owners and finders are individuals who each control infinitesimal amounts of caches and logs when compared to the entire listing site. The person or entity that has the power sets the tone of the game. Because the site has the power and sets the tone of Geocaching, I tend to champion the cause of the cache owner and finder, rather that of the site. They don’t need help, but they do tolerate dissention in the

ranks. ^_^

Thank you for affirming that I have the right to hide a cache full of fireworks just off the railroad tracks that run through the National Forest Wilderness Area. I feel so..... empowered. ^_^

To address one of our more smartalec moderators:

 

Yes, Lep you have the right to place hampster caches any way you want. As you didn't point out though you only have the right to request that it be listed on a listing site such as GC.com and they can point at the guidlines they have the right to implement and laugh their butts off that you as an ninja hampster would submit such a cache.

 

Alas the RR also has the right to charge you with tresspassing which is why while you can place a cache anywhere you dadgum well want you still have to face the consequenses of having done so. But you knew that being a laywer and knowing what being subject to the laws of the land means.

 

You also have the right to say whatever you want in the forums, but they er... you have the right to moderate yourself... Hmmm. ^_^

1. I have the RIGHT to hold an opinion as a geocacher, separate from my role as a site volunteer. I endeavor to post using the correct account. Regardless of how I post, my posts are subject to the Forum Guidelines. I believe that my posts to this thread are not violative of the Forum Guidelines. They were exploring the scope of the RIGHTS espoused in the original post. If another moderator should disagree with my assessment, it is their sworn duty to spike my warn meter.

 

2. I have the RIGHT to be free from personal attacks in violation of the Forum Guidelines. You have called me a smartalec, and worse yet, a lawyer. I'm hurting.

 

3. Hamstercaching already has a private label site. I just didn't invite you. ^_^

We all have the right to free speech. Even the ones that continually spew male cow dung in the forums voicing their discontent with how the site is run. Some of us also reserve the right to dispute such dung as mentioned above in order to preserve what we conceive as a good and harmonious site.

 

We also concede that the afore mentioned party is likely to take exception to the preceding statement. Therefore any response by that party will be given little or no thought. The posture that we take may seem harsh, but given the case history of the complainant, it is fair.

Lastly, if you don't agree with this, you are beneath notice and though that might be harsh, it's justified because of past performance.

 

Did you have a point with this post or was I right in thinking you were practicing your witty repartees? If I recall last time you got into a debate you felt the need to appologize because you got a little carried away with the "good and harmonious" banter while countering all the BS. Here is a tip. Once you disengage the brain, it's all BS. Better watch that.
