My brother hid a few geocaches, one is in MY OWN back yard only accessible from a cemetery.  He has since passed away. How am I able to adopt this cache and some of his others since he is unable to correspond and do the original C.O portion of the adoption process?

I would contact HQ. Unless you have his password, that's the only option.

I haven't gone through it myself, but my understanding is that the deceased CO's heirs can tell Groundspeak what to do with the caches (e.g., via email), and the lackeys will work out the details. The heirs don't need to have/create accounts on the geocaching.com site.
