The first thing that comes up on Google for me is this page with various policies relating to Tennessee This page indicates that there is a permit system for state parks, city parks can vary, and stay away from Cracker Barrels. I understand what you are saying but I take the question as much more generic than a very specific spot for a particular cache - therefore the best answer is to locate a local Geocaching group - they likely are familar with what areas are most open to caching and those areas that are off limits.
