They wanted to arrest me as a spy because they didn't understand what I was doing. Try to explain benchmarks to the PD. sixthings Posted February 16, 2003 Share Posted February 16, 2003 i am always careful where i go hunting for benchmarks. if there is a mark that i want to find, and i may arouse suspicion doing so, i may pass on it, or research it thoroughly and try to find it as quickly as possible. many of the marks out there are on or around the infrastructure that is getting more protection now than ever (bridges, dams, big federal buildings). the sight of me with a 2 day old shave, a surplus army jacket, a camera and a GPS poking around the bushes next to a dam would probably cause some panic. and i don't disagree. of course, i've also been hassled by a mall security guard rent-a-cop for walking on the grass looking for a mark... Do you mean the men and women that are sworn to protect the lives and property of others? I am one of "these people" and I take offense to such a statement as made by you. I wasn't there to see what happened, but I do know that there are two sides to every story. The local reservoirs around Birmingham are also now being gaurded by police officers so I do understand how you may have encountered an officer by being near a reservoir, but I can't see how you would think an officer, questioning your presence, would be overreacting. In most states, Surveyors are immune from Trespass laws, if the are on official business, have Identification and are in cearly marked vehicle's. Of course this does not mean they can just go anywhere, they has to respect the property and owners as seek permission. Note -Not all public property is open to the public. The cops are going to hassel you sooner or later hunting for geodetic control. Heck, I worked for state gov't for 31 yrs and there were a couple of times they gave us a hard time for reasons unknown to us. Just trying to show us who was in charge. Quote Link to comment

I was out looking for benchmarks on Saturday and my friend commented, people must think we're kind of nutty, taking pictures of curbs. I stated back, that's one of the reasons when I go out either geocaching or benchmark hunting that I take the log sheet from that cache or benchmark. It gives a little validity to what you're doing in case someone gets suspicious and calls the local authorities. We found one benchmark (microwave tower) that we could see from a distance, but couldn't get up close to it because of no trespassing signs. The signs were for the local dam, and not the benchmark, which was on top of a small hill. There is another way into the benchmark, but it will mean a more roundabout way, but at least that way will be legal. We didn't have time to take that route this time, but I suspect that we will be able to get to it next weekend. Those reservoirs are CLEARLY marked with MANY MANY no tressspassing signs all along the FENCES which surround the reservoirs. Sometimes the benchmarks were put in those areas to be protected, or because they were being used by that area, whatever that area's purpose may be (like a reservior/dam, an airport or beacon, a military base, etc). Sometimes the restrictions grew up around the areas more recently and consequently, around the benchmarks. If you're afraid that your searching for a benchmark is likely to arouse some suspiscion due to the area it is in, why not go to the managing agency of that area - the police, the park ranger, the military, the airport general manager - tell them what you are doing, and ask permission to be there. You may get told that you are not welcome to search, or that you can only search in certain areas, or that you can go if you're escorted. It sound like a bit of trouble, but it could save both sides a whole lot of hassle and headache. You may find that as long as they know you're there and what you're doing, they won't bother you at all. If the mark is on private property, ask the property owner. If the mark is on, or near restricted public lands, ask the managing agency. If it's in the public right-of-ways or public lands, don't worry about it, just go find it.
