I always identify it as such and am happy to answer questions about it. In the case of my old phone: The buyer was local, negotiated a price we were both happy with, tested the device in hand before paying, and understood I was selling it without warranty. Watch for my next deal here -- new iPhone models are expected this summer. A few months after they're out (so I can tell if they're cool or crud), I may upgrade again and my iPhone 3G will be up for sale with similar terms. The market for used iPhones is weird though. They typically sell for more than new ones -- because AT&T will sell you a phone without contract now -- for $400 above the regular price ("regular" meaning "with a 2yr contract"). Even with that premium, these aren't unlocked. You'd still have to run QuickPWN or similar to use them off of AT&T's network. But this drifts from the topic of items currently for sale.
