Wardriving

Without debating the ethics of 'wardriving', here's a link to the article where a man was arrested in Florida back in April for sitting in front of someone's house 'stealing' his wireless Internet while in a parked car.

Wi-Fi cloaks a new breed of intruder - St. Petersburg Times, July 4th

Apparently he was charged with a third-degree felony in Florida for unauthorized use of a computer or network.

Yeah ... but that is Florida.

If I recall correctly that guy was parking there for over an hour before the home owner spotted him using his laptop. A USB WiFi adapter with some Chinese Cookware could have avoided that.

Wardriving has very little to do with illegally accessing someones home network or the internet. It would be like saying window shopping is unethical because some of the people who window shop will also shoplift.

Not only do you not have to access someones network to detect a wireless access point. You don't even have to transmit. Most units are set up to beacon, or announce who they are, automatically. All you wireless NIC has to do is listen.
