  1. I was wondering if there has ever been an estimate on how much trash has been removed from the environment via CITO either in sponsored events or just general practices?
  2. Santa left a tiny box and a coordinate to locate a present at X-mas. The gift was too large to fit down the chimney ( a bike). Coordinates were to a shed in the yard. This was for an older child. He thought it was cool.

  5. Please don't misunderstand. I am all for doing everything we can to stop this bill. I am just suggesting that we will likely have time after this Session to try to educate more Senators before a vote in the Senate. Am I right on the process needed to [get] the bill passed this year?
  6. So, the Senate must get the bill out of sub-committee without any changes, back to the full committee, which would have to recommend that the bill be brought before the full Senate. Then, 2/3 of the Senate would have to vote "Aye" to get the bill properly introduced this term (which ends the 31st?). This 2/3 vote is necessary because the bill passed a deadline for making [it] to the Senate. Then the bill would be up for discussion on the floor of the Senate and would have to be passed unchanged. All of this by the end of Session on Tuesday. Are we in panic mode because we think all of this is going to happen? Am I wrong on how this process works?

  8. Does anyone know why trespassing laws would not apply to cemeteries? Here are most of the trespass laws that could be applied directly or with MINOR tweaking. I am not a lawyer or lawmaker so please help me understand this. I think that SECTION 16-11-620 below is the law that seems to cover this issue (or does this just deal with a residence?). SECTION 16-11-640. Unlawful entry into enclosed places. [sC ST SEC 16-11-640] It shall be unlawful for any person not an occupant, owner or invitee to enter any private property enclosed by walls or fences with closed gates between the hours of six P.M. and six A.M. The provisions of this section shall not apply to any justifiable emergency entry or to premises which are not posted with clearly visible signs prohibiting trespass upon the enclosed premises. The provisions of this section are supplemental to existing law relating to trespass and punishment therefor. Any person who violates the provisions of this section shall be deemed guilty of a misdemeanor and upon conviction shall be fined not less than twenty-five dollars nor more than two hundred dollars or imprisoned for not more than thirty days. SECTION 16-11-600. Entry on another's pasture or other lands after notice; posting notice. [sC ST SEC 16-11-600] Every entry upon the lands of another where any horse, mule, cow, hog or any other livestock is pastured, or any other lands of another, after notice from the owner or tenant prohibiting such entry, shall be a misdemeanor and be punished by a fine not to exceed one hundred dollars, or by imprisonment with hard labor on the public works of the county for not exceeding thirty days. When any owner or tenant of any lands shall post a notice in four conspicuous places on the borders of such land prohibiting entry thereon, a proof of the posting shall be deemed and taken as notice conclusive against the person making entry, as aforesaid, for the purpose of trespassing. SECTION 16-11-610. Entry on another's lands for various purposes without permission. [sC ST SEC 16-11-610] Any person entering upon the lands of another for the purpose of hunting, fishing, trapping, netting; for gathering fruit, wild flowers, cultivated flowers, shrubbery, straw, turf, vegetables or herbs; or for cutting timber on such land, without the consent of the owner or manager, shall be deemed guilty of a misdemeanor and upon conviction shall, for a first offense, be fined not more than two hundred dollars or imprisoned for not more than thirty days, for a second offense, be fined not less than one hundred dollars nor more than two hundred dollars or imprisoned for not more than thirty days and, for a third or subsequent offense, be fined not less than five hundred dollars nor more than one thousand dollars or imprisoned for not more than six months or both. A first or second offense prosecution resulting in a conviction shall be reported by the magistrate or city recorder hearing the case to the communications and records division of the South Carolina Law Enforcement Division which shall keep a record of such conviction so that any law enforcement agency may inquire into whether or not a defendant has a prior record. Only those offenses which occurred within a period of ten years, including and immediately preceding the date of the last offense, shall constitute prior offenses within the meaning of this section. SECTION 16-11-620. Entering premises after warning or refusing to leave on request; jurisdiction and enforcement. [sC ST SEC 16-11-620] Any person who, without legal cause or good excuse, enters into the dwelling house, place of business, or on the premises of another person after having been warned not to do so or any person who, having entered into the dwelling house, place of business, or on the premises of another person without having been warned fails and refuses, without good cause or good excuse, to leave immediately upon being ordered or requested to do so by the person in possession or his agent or representative shall, on conviction, be fined not more than two hundred dollars or be imprisoned for not more than thirty days. All municipal courts of this State as well as those of magistrates may try and determine criminal cases involving violations of this section occurring within the respective limits of such municipalities and magisterial districts. All peace officers of the State and its subdivisions shall enforce the provisions hereof within their respective jurisdictions. The provisions of this section shall be construed as being in addition to, and not as superseding, any other statutes of the State relating to trespass or entry on lands of another. SECTION 15-67-610. Duty of magistrate in case of trespass. [sC ST SEC 15-67-610] If any person shall have gone into or shall hereafter go into possession of any lands or tenements of another without his consent or without warrant of law, the owner of the land so trespassed upon may apply to any magistrate to serve a notice on such trespasser to quit the premises, and if, after the expiration of five days from the personal service of such notice, such trespasser refuses or neglects to quit then such magistrate shall issue his warrant to any sheriff or constable requiring him forthwith to eject such trespasser, using such force as may be necessary.

  10. The only thing I now know about our government in SC is that they waste alot of time. Mindless introductions and resolutions, endless free breakfasts, lunches, dinners and social events, and poorly worded bills/laws. They adjourned early the other day, cutting short debate on the Criminal Domestic Violence issue so some members could make it to a basketball game with NC legislators. They are out of control .... too many list their occupation as "full-time legislator". Truly sickening.
  11. I would rather cut the head off of the snake. By the way, if anyone else is watching the House in action today, Bill 3777 is not the only poorly written bill or amendment. And just how many people need to be introduced? These people work for 6 months ... I think maybe we should cut their salaries in half and let them get their "work" done in three months. Maybe that would keep the bills focused on what is needed, not a bunch a knee-jerk legislation. Had to add "" to the word work.
  12. What exactly is it that geocachers have done? A couple of inappropriate posts in an obscure forum? They keep mentioning vandalism, but I have not heard of any vandalism that was tied to geocaching. My understanding (please correct me if I am wrong) is that the cache in question was removed once an objection was raised. This bill would not be the end of geocaching in SC, but it would cripple users in some areas (ex. Charleston) because of the amount of state historic properties and the amount of (unknown) archeological sites. Could we still use historical markers as virtual stages in multi-stage caches? There are too many questions because of the ridiculous wording of the bill. If this were limited to cemeteries I don't think there would be as many arguments.
  13. I sent e-mails to all of the sponsors of the bill (except Ceips... seemed like a waste of time based on other posts) and my own representative and senator. I got an e-mail back from my senator who stated that he has some problems with the bill, but also mentioned some "vandalism" had occurred at a cemetery in the lower part of our state. Of the e-mails sent to reps in the house, I got two auto-replies and one personal note from one of the sponsors stating that he would forward my e-mail to other members. This whole thing has really opened my eyes to the process of law-making in our state. We have WAY to many people that list their occupation as full time legislators. If legislator is the only job that you have, maybe bills like House 3777 make more sense.
  14. If an archeological site was located in an area previously identified by a hunter, and a hunter used a GPS to find this "specific location", would he not be in violation of the law? No, they are not trying to stop hunting, or fishing, but both of these activities may involve the use of a GPS to find a "specific location".
  15. Any NRA members? Maybe the NRA would be interested in the bill .... hunters may not be able to legally use their GPS to return to their favorite hunting spot! As far as simple explanations of geocaching .... type in geocaching in Google and then click on the News tab ... many recent articles from around the country.
  16. Question ..... I have gotten a reply from my state senator who graciously took the time to reply to my e-mail re: house bill 3777. He said he has some problems with the bill as it is currently written, but mentions the "vandalism" of a cemetery in the low country. Has anyone determined that a geocacher vandalized anything? Or was it merely the presence of people in a cemetery and photos/posts deemed inappropriate? What actually started this mess (other than the overreaction of Mrs Ceips)?
  17. Just wanted to pass along a little more info.... Catherine Ceips, who started this anti-geocaching nonsense, has had other targets in the past....... Ceips Against Free Speech (I was not a fan of what they said either, but come on....) She is also a member of the South Carolina House Tourism Caucus List of Legislators on SC Tourism Caucus This is also quite interesting...... I wonder if the archeologist used a GPS to mark the location ...... Ceips Historical Site?

  19. I hate to admit it, but this issue just popped on my radar within the last couple of days. It took awhile to wade through all of the posts. It seems the issue is still fairly fluid. I have done my bit and e-mailed my House and Senate reps. I may follow up with a snail-mail version. As a resident of South Carolina, I am shocked again and again by the topics our reps choose to target when our education system is sliding off of a cliff ( I guess being 50th is already at the base of the cliff). Please clarify the following scenario ....... Someone has a GPS enabled phone and records a location at a state historic site in Charleston. They e-mail the location to a friend, hoping they can check out the "neat" spot the next time they visit. Is this a violation? Maybe not "geocaching", but you still are finding a "specific location". This whole thing is just plain moronic!
