  1. Just received this from my Rep.: ** High Priority ** The following ammendment has been added to the geo caching bill: "Section 16-17-605. (A) It is unlawful for a person to engage in any gaming, sporting, or other recreational activity in a cemetery, burial grounds, or archeological site without the express written consent of the owner or the state agency which oversees these properties or sites. ( A person who violates the provisions of this section is guilty of a misdemeanor and, upon conviction, must be fined not more than one hundred dollars or imprisoned for not more than thirty days. © Notwithstanding the provisions of subsection (, the judge, in his discretion, may order a person convicted of a violation of this section to perform up to one hundred hours of community service. (D) The provisions of this section do not preclude a person from being charged with a violation of Section 16-17-600 in addition to a violation of this section." SECTION 2. The repeal or amendment by this act of any law, whether temporary or permanent or civil or criminal, does not affect pending actions, rights, duties, or liabilities founded thereon, or alter, discharge, release or extinguish any penalty, forfeiture, or liability incurred under the repealed or amended law, unless the repealed or amended provision shall so expressly provide. After the effective date of this act, all laws repealed or amended by this act must be taken and treated as remaining in full force and effect for the purpose of sustaining any pending or vested right, civil action, special proceeding, criminal prosecution, or appeal existing as of the effective date of this act, and for the enforcement of rights, duties, penalties, forfeitures, and liabilities as they stood under the repealed or amended laws. SECTION 3. This act takes effect upon approval by the Governor./ In a nutshell, this is a comprimise stating that you can continue to do this hobby but will have to get written permission to go on private cemetary lots and burial grounds. Originally, this included archaelogical sites and they are now in the process of debating taking those off. Would you be ok with this comprimise because this may be the best we get? Please let me know asap as we are debating the bill now. Thanks, Nikki
  2. Hi folks, I emailed my rep yesterday and here's her response. Mr. Giles, Thank you for taking the time to write concerning H3777 limiting Geocaching. Geocachers have proven to be a responsible, educated group. I will vote against this legislation. If I can ever be of service to you at any time, please don't hesitate to contact me. Nikki >>> "Giles, Craig" <SSC8ED02@Allstate.com> 4/27/2005 11:10:26 AM >>> Hi Mrs. Haley, As one of your constituents I would like to express concern over H.3777. I was at a Boy Scout meeting last night and one of my Scout dads brought the bill to my attention. Realizing you're very busy, I won't take much of your time. It appears that there may be a lack of accurate information in the legislature concerning Geocaching. Below are several links to Geocaching events of which you should be aware. I send these to illustrate that the vast majority of us participating in this sport are responsible community and environment minded individuals and that Geocaching is endorsed by many organizations. Cache In Trash Out Photos - http://tinyurl.com/cp6ot Salvation Army Geocaching - www.kettlecache.com National and International Press on Geocaching - http://www.geocaching.com/press/ My concern is that this bill is too invasive, is being pushed based on incidents that aren't linked to Geocaching and incidents that demonstrate a lapse of judgment by a few individuals (the photos by the grave stone shown by Ms. Ceips). As a Geocacher, I've participated in this sport with my sons, my Scout Troop and my friends and we've all come away richer for the experiences. At your convenience, please let me know your position on this bill. I have provided contact information below and would be pleased to hear from you. Best Regards, Craig Giles
  3. Hi folks, Very late to this topic. A friend let me know what was going on last night. I've contacted both my representative, Nikki Haley and Bill Herbkersman, an acquaintance and one of the bill sponsors. Bill replied quickly. His reply was positive and indicated that he wished for there to be debate on the subject. He also indicated that he would forward my message to all of the other members. Hope my rep. is as responsive......
  4. Thanks guys. I'll shoot TinSparrow an email to see what hints he/she will share. I appreciate the responses.
